SCOTUS Gun Watch - Week of 6/19/23

As summarized in last week's update, the major upcoming developments on the Second Amendment front are the cert decisions in Rahimi and Seekins.  These will likely come on Monday, June 26, following the Court's final conference of the term this Thursday, June 22.

This week, I'm adding one new case to the tracker: Kyung Chang Industry USA, Inc. v. Eighth Judicial District Court of Nevada et al.  Kyung Chang involves a question of statutory interpretation, namely whether a firearm magazine is a "component part of a firearm" and thus covered by the Protection of Lawful Commerce in Arms Act, or PLCAA.  The petitioner (commonly known as KCI) "manufacture[s], imports and distributes magazines to wholesalers for semiautomatic firearms."  One such magazine was used in a shooting in August 2019 and the victims sued KCI for negligent manufacture.  A Nevada state trial court denied KCI's motion to dismiss under PLCAA because it found that the magazine in question was not a "component part" and thus the suit was not precluded by PLCAA, and the Nevada Supreme Court then denied a request for a writ of mandamus.  The petition argues in part that other federal and state courts have articulated a broader definition of "component part" that includes magazines.  It's notable that the petition in Kyung Chang seeks to compel an interlocutory ruling from the Nevada Supreme Court, which determined that factual issues remained to be determined by the trial court, and I think that makes it unlikely that the petition will be granted (not to mention that PLCAA does expressly exempt lawsuits based on alleged product defects).  The petition for certiorari was filed on June 9, and Nevada waived its right to respond on June 14. 

On June 16, the Court released its opinion in Lora v. United States.   Writing for a unanimous Court, Justice Jackson explained that "[a] sentence for a §924(j) conviction [for causing the death of a person through the use of a firearm] can run either concurrently with or consecutively to another sentence" because it is not subject to 924(c)'s bar on concurrent sentences.  Lora continues the recent run of success for gun-crime defendants at the Supreme Court, which Jake described in a prior post
