SCOTUS Gun Watch - Week of 6/17/24
The Supreme Court issued its decision in Cargill last Friday, with a six-justice majority affirming the Fifth Circuit and holding that ATF exceeded its statutory authority under the National Firearms Act by promulgating a rule that classified bump stocks as "machineguns." We'll have more coverage of Cargill on the blog in the coming weeks. Rahimi remains among the cases still to be decided by the end of the term; the justcies are next set to issue decisions on Thursday morning.
On June 14, the National Association for Gun Rights filed an amicus brief in Wilson v. Hawaii—where the Hawaii Supreme Court construed Hawaii's state constitution to protect a militia-only right to keep and bear arms. The brief argues in part that "lower court defiance of this Court’s Second Amendment precedents has reached crisis proportions." As I explained in our earlier summary of the decision, the court's brief application of Bruen as continuing to allow states to maintain firearm licensing isn't all that debtable and there's little chance the Supreme Court takes up the case.
This morning, the Court released an order list and added four new cases to its docket for OT 2024. There were no developments, however, with the major Second Amendment cases we are tracking as potential candidates for next term (NAGR and Antonyuk).
