SCOTUS Gun Watch - Week of 7/15/24

With the end of the Supreme Court term and the Court's annual recess, our SCOTUS update will now run bi-weekly for the rest of the summer.  The justices will re-convene in late September for the Long Conference, where they will deal with cert petitions filed and briefed over the summer and likely add to their docket for the coming term.  The Court is already set to hear one gun-related case next term: VanDerStok, an administrative-law challenge to ATF's regulation of gun-assembly kits (or "ghost guns") as "firearms" under the Gun Control Act.

On July 3, the government of Mexico filed its response in Smith & Wesson v. Estados Unidos Mexicanos—a case dealing with the application of PLCAA's civil immunity shield for gun manufacturers to claims by Mexico that certain gunmakers caused damage in the country by knowingly implementing distribution practices that allow American guns to be easily trafficked to Mexican drug cartels.  Back in January, a First Circuit panel held that Mexico's complaint plausibly stated a claim for relief despite PLCAA and reversed the district court's dismissal of the complaint.  In its response, Mexico argues that its "Complaint alleges in detail that Petitioners knowingly and actively design, market, and sell their firearms in such a way as to 'maintain the unlawful market in Mexico,'" rather than simply being indifferent to such dowstream outcomes.  Mexico asserts that there is no circuit split on the specific question presented regarding proximate cause under PLCAA and argues that the Court should refrain from granting cert at this early stage (before discovery and summary judgment briefing).
