"CHAPTER 49. 
CRIMES AND PUNISHMENTS. 
AN ACT defining crimes and punishments...

...ASSISTING PERSONS IN JAIL TO ESCAPE, ETC.

Sec. 72. If any person shall aid or assist a prisoner, lawfully committed or detained in any jail, for any offense against this territory, or who shall be lawfully confined by virue of any civil process, to make his or her escape from jail, though no escape be actually made, or if any, person shall convey or cause to be delivered to such prisoner any disguise, instrument or arms, proper to facilitate the escape of such prisoner, any person so offending, although no escape or attempt to escape be actually made, shall, on conviction, be punished by fine not exceeding five hundred dollars nor les than one hundred dollars, and imprisonment in the penitentiary, at hard labor, for a term not exceeding two years."
