SCOTUS Gun Watch - Week of 8/15/22
There are not many updates on the Supreme Court front, as the summer recess rolls on. A few more of the cases we are tracking will be considered at the Long Conference in late September, including Morin, Baldea, and Torcivia.
The four cases that the Court GVR-ed post-Bruen are still being litigated at the appellate level. In Bianchi v. Frosh—a challenge to Maryland's assault weapons ban—the Fourth Circuit recently ordered supplemental briefing, with opening briefs due August 22.
Two amicus briefs were filed earlier this week in McCutchen, a takings-clause challenge to the ATF's bump-stock ban. One brief, filed by Montana and 16 other states in support of the petitioners, argues in the alternative that, under Chevron, "[t]he ATF's interpretation of 'machine gun' should also garner no deference because the statute implicates the fundamental right to keep and bear arms." In other words, according to the amici, the bump-stock ban is per se unreasonable in part because "criminalizing [bump stocks] obviously implicates Americans’ Second Amendment rights." The brief cites to the district court decision in Miller v. Bonta (which Jake covered here) to argue that bump stocks are protected under the Second Amendment because they are used to increase the rate of fire of popular, commonly-owned guns such as the AR-15.
