SCOTUS Gun Watch - Week of 2/27/2023

This morning, the Court denied certiorari in Beemer v. Whitmer.  The petitioners in Beemer had sought clarification of whether Michigan's now-lifted emergency pandemic orders (including the closure of gun stores) could be challenged on constitutional grounds under the mootness doctrine.   

We've also belatedly added an additional case to the tracker:  Lora v. United States.  The issue in Lora, as described in the petition for certiorari, is:

Whether 18 U.S.C. § 924(c)(1)(D)(ii), which provides that “no term of imprisonment imposed . . . under this subsection shall run concurrently with any other term of imprisonment,” is triggered when a defendant is convicted and sentenced under 18 U.S.C. § 924(j).

The petitioner in Lora was charged and found guilty, after a trial, of violating 18 U.S.C. § 924(j) by using a firearm to commit murder in furtherance of a drug trafficking conspiracy.  The defendant was also convicted on additional counts, and the question is whether the 924(c) provision required the judge to impose Lora's sentences to run consecutively, rather than concurrently.  The Court granted certiorari in December 2022, and the case is set for oral argument on March 28.  As Jake Charles summarized in a post last summer, criminal defendants have had a run of recent success at the Supreme Court with challenges to gun-related sentencing provisions.  Lora may continue that trend, and we'll be tracking the case in the lead-up to oral argument.
