SCOTUS Gun Watch - Week of 4/24/23
The Court denied certiorari today in Gazzola, a challenge to certain New York regulations on the commercial sale of firearms, noting that the petition had been filed "before judgment." Vullo, a First Amendment challenge involving state government guidance and press urging banks and insurance companies to consider the reputational risks of doing business with gun-rights organizations, was distributed for consideration at the Court's upcoming May 11 conference.
With the recent extension, the response brief in Rahimi is now due on May 23. Seven amicus briefs in support of the government's petition for certiorari were filed on April 20—we'll run a future post breaking down the cert-stage amicus briefs on both sides once the response deadline has passed.
While we're not officially adding it to the tracker, a petition for certiorari was filed on April 12 in NST Global, LLC (dba SB Tactical) v. Sig Sauer, Inc. The underlying case is a patent infringement dispute between SB Tactical and Sig Sauer regarding stabilizing braces (the subject of a Biden administration regulatory rule that A.W. Geisel covered in a recent guest post). The Court of Appeals for the Federal Circuit affirmed a ruling in Sig Sauer's favor that invalidated portions of the relevant patents held by SB Tactical.
