SCOTUS Gun Watch - Week of 7/10/23
With the end of the Supreme Court term, the major news remains the Court's decision to take a major Second Amendment case (Rahimi) just one year after deciding Bruen. That is a marked departure from the Court's past practice, as the justices generally avoided Second Amendment cases between 2010–when the Court decided McDonald–and 2019–when the Court granted cert in NYSRPA I (Caetano, decided in 2016, produced only a very short per curiam reversal).
Based on oral argument timing last term, cases where cert is granted in late June are generally argued in November or early December. While extension requests may impact the timeline, this would mean that the opening briefs in Rahimi (the government's brief and any supporting amicus briefs) will likely be due in mid-late August. Rahimi's response and supporting amicus briefs would then be due one month later, in September.
I offered some initial thoughts about Rahimi in last week's SCOTUS update, and we will have more analysis in the coming weeks on the blog. I expect the Court to reverse the Fifth Circuit, although I think the breakdown of justices and the breadth of the holding remain very open questions. It's worth noting that the Fifth Circuit had a less than stellar showing at the Supreme Court this past term, with only two out of nine decisions affirmed in full.
The NRA filed its reply brief in Vullo on July 7, and that case will likely be distributed for the Long Conference in September shortly.
