SCOTUS Gun Watch - Week of 7/17
There are just a few updates on the Supreme Court front this week. It is likely the Supreme Court will not announce the oral argument date in Rahimi for another few weeks. The Court released its oral argument schedule for early-mid October last week. The other possible argument dates this year are October 30-November 1, November 6-8, November 27-29, and December 4-6.
Vullo, a case challenging guidance issued by New York state urging financial institutions to consider the reputational risks of doing business with the firearms industry on First Amendment grounds, was distributed for conference in September (joining two other cases on the tracker, Cargill and Kyung Chang). In my opinion, the case that is far and away the best prospect for a cert grant is Cargill, given the recent appearance of a circuit split over whether ATF's bump-stock rule was a permissible agency action. In Guedes, which also involves the bump-stock ban, the government's response is now due on August 21.
