SCOTUS Gun Watch - Week of 8/14/23
The major development last week at the Supreme Court was the Court's text order on August 8 granting the government's emergency docket application for a stay in Garland v. Vanderstok. A district court judge had entered judgment striking down ATF's rule classifying certain gun component parts as "firearms" under the GCA on administrative law grounds (the rule was designed to capture so-called ghost guns, unserialized firearms often sold in "kit" form). The Fifth Circuit had denied the government's motion for a stay pending appeal, but the Court granted that relief by a narrow 5-4 margin. Chief Justice Roberts and Justice Barrett are the two members of the Bruen majority who voted in favor of the stay (there was no written opinion or dissent). Per the government's emergency stay application, the Fifth Circuit will hold oral argument in Vanderstok on September 7.
In Rahimi, the government's opening merits brief is due today (August 14) with supporting amicus briefs due 7 days later (August 21). We'll have coverage of those briefs on the blog in the coming weeks. Respondent's opposing brief would then be due by September 13; but, on August 4, respondent's counsel filed an agreed motion to extend that deadline to September 27. It seems likely the Court will grant the motion, which may mean that the oral argument occurs slightly later than expected (perhaps during one of the three argument windows in December and January).
