SCOTUS Gun Watch - Week of 10/30/23
The government filed its reply brief in Rahimi on October 25. The government argues that Bruen "incorporated the 'law-abiding, responsible citizen' principle into its analytical framework," and that the phrase is not mere dicta or gloss. The government also contends that Bruen contemplates consulting a wide variety of historical sources apart from enacted regulations and argues against "artificial limit[s that] would make the Second Amendment a constitutional outlier." The government reiterates its central argument that "historical sources from England, the Founding Era, and the 19th century all reflected the understanding that legislatures could disarm persons who are not law-abiding, responsible citizens" and states that "Rahimi cites no historical sources or judicial decisions—literally nothing—suggesting that legislatures lack authority to disarm dangerous individuals." The brief also responds to arguments about alleged procedural deficiencies with 922(g)(8) and says that historical "laws show that Congress may disarm a dangerous category of persons even if particular members of the category would not necessarily be dangerous if armed." The case is now fully briefed, and the Court will hear argument on Tuesday, November 7. Rahimi is the only case set for argument on the 7th, which will begin at 10:00 am Eastern Time.
The Court considered Vullo at its October 27 conference but did not issue any order in that case this morning. The Court has redistributed the three bump-stock cases for consideration at its November 3 conference.
