SCOTUS Gun Watch - Week of 10/9/23
Between September 22 and October 4, 22 amicus briefs were filed in support of Rahimi at the Supreme Court. The organizations filing briefs include public defender groups, gun-rights organizations, empirical researchers, and conservative think tanks. While some briefs argue in favor of the Fifth Circuit's historical analysis and determination that 922(g)(8) is inconsistent with America's historical tradition of gun regulation, amici also raise a variety of issues not litigated at the trial court or appellate levels—including due process and concern with the lack of procedural protections available to respondents in underlying DVRO proceedings, arguments that Congress lacks the power to regulate individual gun possession under the original understanding of the Commerce Clause, and empirical arguments that 922(g)(8) is not effective at addressing the escalation of domestic violence. We will have further coverage of some of the arguments raised in the amicus briefs on the blog in the coming weeks. The government's reply brief is due on October 27, and oral argument will take place on November 7.
Vullo was redistributed for last Friday's conference, but the Court will not issue an orders list today due to the holiday. No reply was filed in Hardin. The Court is now set to consider the three petitions involving administrative law challenges to ATF's bump-stock rule (Hardin, Cargill, and Guedes) at its October 27 conference.
As of today it appears that no petition for review has been filed in Range, where the en banc Third Circuit struck down the federal law banning felon possession of firearms as applied to a nonviolent felon. The government sought and received an extension of the cert deadline through October 5 (to my knowledge, there was no further extension request). It's possible that a petition was filed in Range and that it is not yet available on the Supreme Court's docket, as petitions can sometimes take a few days to appear. We'll have additional updates and analysis in subsequent SCOTUS posts.
