SCOTUS Gun Watch - Week of 1/29/24
There was no orders list from the Court this morning, and thus no update on the pending 922(g) petitions including Range. The Court's next scheduled conference is Friday, February 16.
The respondent filed his merits brief in Cargill on January 22. Per the brief, Cargill "owned two Slide Fire bump-stock devices . . . [which he] surrendered under protest [after ATF's ban] and then sued to 'set aside' the ATF rule." Cargill argues that the devices fall outside of the statutory definition of a "machinegun" because they do not cause more than one shot to be fired by a single function of the trigger. Therefore, Cargill says, ATF's de facto ban of these devices exceeded the agency's authority. According to Cargill, "if th[e] Court finds the statutory language capable of supporting either Cargill’s or the Solicitor General’s position, then it should interpret the statute for itself rather than presume a delegation to ATF, as the Chevron framework is inapplicable to statutes that define criminal offenses." On the other hand, if the statute is ambiguous, "the rule of lenity is implicated and a ruling that endorses ATF’s interpretive rule will raise serious constitutional questions."
There is no substantive Second Amendment claim in Cargill, and even the "serious constitutional questions" referenced in Cargill's brief don't appear to relate directly to the Second Amendment; rather, the brief states that "[a]llowing an agency to retroactively expand the scope of a criminal statute" presents serious due process concerns. In any event, Cargill will be an interesting case to follow especially in light of the Court's recent oral argument in Loper Bright and the possibility that the Court will scuttle Chevron deference entirely. If so, it's not inconceivable that the Court could simply grant, vacate and remand Cargill, presumably to be affirmed under the new approach to agency deference. Cargill does, however, implicate slightly different issues due to the criminal penalties associated with the ATF ban and the rule of lenity.
