SCOTUS Gun Watch - Week of 3/11/24
The Court is not scheduled to issue an orders list today and will hold its next conference on Friday, before moving into back-to-week argument weeks. Vullo will be first up on Monday, March 18 at 10 am Eastern Time. Jackson is set for consideration at the March 15 conference.
The respondents in VanDerStok, which involves a challenge to ATF's regulation of certain firearm component parts, filed their cert-stage opposition briefs last Thursday. Notably, both groups of respondents agree with the government that the Court should grant certiorari. For example, VanDerStok's brief argues that Supreme Court review is appropriate despite the "firm[] belie[f] that the Fifth Circuit correctly resolved the merits of this case" – in large part because the ATF rule remains in effect even following the Fifth Circuit's decision. The brief filed by Defense Distributed and other respondents argues that the "Rule will succeed in destroying an entire field of traditionally lawful Second Amendment business activity that ATF has no right to regulate." Two amicus briefs were also filed on behalf of the government, one by 20 states plus DC and one by a group of gun violence prevention organizations.
