SCOTUS Gun Watch - Week of 3/18/24
The Court is hearing oral argument in Vullo today, a First Amendment challenge by the NRA to regulatory guidance issued by New York state in 2018 urging banks and insurance companies in the state to consider the "reputational risks" of doing business with gun-rights advocacy groups. The Second Circuit held that the NRA's First Amendment claims failed as a matter of law because, in its view, the state's language did "not cross the line between an attempt to convince and an attempt to coerce." Even if the Supreme Court reverses, there remains a qualified immunity question lurking in the background (on which the Court has not granted cert). The United States will take part in oral argument, after filing an amicus brief in suppport of neither party suggesting that at least some of the First Amendment claims in the case should proceed.
The Court issued an orders list this morning, denying certiorari in a number of 922(g) petitions. A set of similar petitions are set for consideration at the Court's next two conferences, and I think it's likely those petitions will either be denied or held pending Rahimi.
