SCOTUS Gun Watch - Week of 4/15/24
Maryland filed its response brief in Bianchi last Friday, April 12. The state argues that "there are no circumstances that would justify the extraordinary step of granting a writ of certiorari before judgment," and that the petitioners "point to no split among the circuits regarding assault weapons bans . . . nor can they credibly argue that the Fourth Circuit's Kolbe decision conflicts with any decision of this Court." As the state notes in its brief, the en banc Fourth Circuit heard argument in Bianchi in late March (for more on the oral argument, see this post).
The government response briefs in Bevis and other challenges to Illinois' assault weapons and large-capacity magazine ban, where the challengers have asked the Court to review the Seventh Circuit's decision upholding the law, will be filed by the end of the day today.
The Court issued an orders list this morning. Certiorari was denied in several 922(g)(1) cases, but the Court did not dispose of the petition in VanDerStok (the administrative-law challenge to ATF's regulation of so-called ghost guns).
