SCOTUS Gun Watch - Week of 8/12/24

On July 25, Pennsylvania filed a petition for certiorari in Commissioner v. Lara.  The case involves a Second Amendment challenge to a set of Pennsylvania statutes that operate to prohibit 18-to-20-year-olds from carrying firearms in public during declared states of emergency.  As we summarized here, in February a Third Circuit panel found the restriction—which had been in place for nearly three consecutive years starting with the COVID-19 pandemic—inconsistent with hitstorical tradition and struck it down.  The full court subsequently voted 7-6 against en banc review.  The state is now asking the Supreme Court to take the case and to opine on the constitutionality of under-21 public carry restrictions and the relevance of historical evidence from the mid-to-late-1800s within Bruen's framework. 

In Smith & Wesson v. Estados Unidos Mexicanos, the First Circuit previously allowed Mexico's claims against U.S. gun manufacturers for allowing guns to reach cartels and cause violence in Mexico to proceed—notwithstanding the Protection of Lawful Commerce in Arms Act, or PLCAA.  The gun manufacturers' cert petition on PLCAA is fully briefed and set for consideration at the Court's Long Conference in September.  The district court had initially punted on a separate motion to dismiss for lack of personal jurisdiction but, after the First Circuit reversed that decision in January, the judge proceeded to consider jurisdictional arguments and dismissed 6 out of the 8 defendants from the case in an August 7 ruling.  The judge found that Mexico "was not harmed in Massachusetts, nor were a significant part—or possibly any—of the acts that gave rise to [the] claims committed in Massachusetts."  It is unclear how that decision will affect the pending cert petition, if at all, and it's possible that Mexico will ultimately attempt to re-file the claims elsewhere. 

VanDerStok, an administrative law challenge to ATF's regulation of gun-assembly kits as "firearms" under the Gun Control Act, is set for oral argument on Tuesday, October 8.  VanDerStok is currently the Court's sole gun-related case for the October 2024 term.  VanDerStok's merits brief is due on August 13, with any supporting amicus briefs to follow a week later.
