SCOTUS Gun Watch - Week of 11/18/24
Maryland filed its response brief in Snope v. Brown, a challenge to the state's assault weapons ban, on November 12. The state argues the Fourth Circuit's conclusions that the banned weapons are outside the scope of the Second Amendment and, alternatively, that the ban comports with historical tradition, are both "straightforward" and consistent with Heller and Bruen. The state also contends that "certiorari would be premature because the courts of appeals have just begun to consider Bruen's application to assault weapons bans."
The Court has requested a response in Gray v. Jennings, where a Third Circuit panel rejected a challenge to Delaware's assault weapon and large-capacity magazine ban on largely procedural grounds (we covered that decision here). Wilson v. Hawaii was re-distributed for the eighth time for this Friday's conference. The Court will also consider the Oakland Tactical petition then, a unique case where the Sixth Circuit rejected a Second Amendment challenge to municipal zoning rules that bar the construction of a long-distance outdoor shooting range.
