SCOTUS Gun Watch - Week of 3/24/25
The Court issued its first orders list in two weeks this morning, denying cert in a handful of Second Amendment cases but once again not addressing the pending assault weapon and large-capacity magazine petitions in Snope and Ocean State (which have now been redistributed eight and nine times, respectively).
In other notable news in the category of protected weapon challenges, the en banc Ninth Circuit issued its long-awaited decision in Duncan v. Bonta on March 20. The court upheld California's large-capacity magazine ban, finding both that the banned magazines are not protected "arms" and, in the alternative, that the law "falls within the national historical tradition of regulating a particular, especially dangerous use of a weapon." Judge Lawrence VanDyke made news by including a video as part of his dissenting opinion that features the judge himself disassembling firearms. The challengers will presumably petition for Supreme Court review in due course, and the California case—like Snope—has been litigated in the lower courts for years since California's law was enacted in 2016 and doesn't present any factual development issues.
The response in Missouri v. United States, where the Eighth Circuit struck down Missouri's Second Amendment Preservation Act as purporting to nullify federal law in violation of the Supremacy Clause, is due this Friday. The justices will also hold a conference on Friday, at which they will consider the petition in Antonyuk v. James—the New York sensitive places and licensing case.
