SCOTUS Gun Watch - Week of 4/14/25
The Court did not hold a conference last week, so the next orders list isn't expected until a week from today after Thursday's conference. Last Friday, the government filed a second consecutive last-minute extension request in United States v. Missouri—which deals with Missouri's "Second Amendment Preservation Act" and the scope of a state's Tenth Amendment authority to refuse to enforce federal statutes notwithstanding the Supremacy Clause.
In another potential reversal, the government requested (and received) an extension of the cert deadline in United States v. Daniels—where the Fifth Circuit has now twice granted an as-applied challenge to the federal ban on unlawful drug users possessing guns brought by a habitual marijuana user. The government's filing states that "[t]he Acting Solicitor General has not yet determined whether to file a petition for a writ of certiorari in this case."
