SCOTUS Gun Watch - Week of 6/9/25
The Court handed down a unanimous decision in Smith & Wesson v. Mexico last Thursday, reversing the First Circuit and holding that Mexico failed to plausibly allege that U.S. gunmakers aided and abetted statutory violations by rogue dealers trafficking firearms to Mexican drug cartels. Therefore, the Court found, Mexico's complaint did not fall within PLCAA's predicate exception and was blocked by the federal immunity law. Justice Thomas and Justice Jackson each filed a short concurrence. Justice Thomas wrote to clarify his view that PLCAA requires a criminal or civil enforcement action (and correspoding finding of guilt or liability) before a private tort lawsuit can proceed—an approach that would substantially narrow the predicate exception. And Justice Jackson explained that, in her opinion, the decision reflects PLCAA's preference for legislation over litigation.
While the decision was unanimous, the justices left open the question of how specific allegations of aiding and abetting a statutory violation must be in order to meet the PLCAA predicate exception. And that may be become relevant in future cases, including if Mexico files an amended complaint in the district court. The Supreme Court suggests that Mexico's complaint would have survived if it had identified specific “bad apple” dealers and alleged that a gun manufacturer sold exorbitant volume to those dealers and offered special discounts to incentivize purchases. There's a lot of daylight, though, between the facts in the Court's most relevant precedent (Direct Sales) and the complaint here.
In terms of practical impact, I don’t necessarily expect the decision to have a major effect on ongoing state lawsuits brought pursuant to firearm-industry nuisance statutes. Those laws attempt to impose more concrete requirements directly on gun makers to monitor their distribution, sales, and marketing practices; while a major shortcoming of Mexico’s complaint here was that, absent such specific requirements at the federal level, Mexico couldn’t plausibly connect the gunmakers to downstream dealer practices given the multi-tiered distribution system.
The Court issued an orders list last Friday, instead of waiting until Monday as is typical. News of the dispositions was prematurely e-mailed to attorneys in an apparent technical glitch, and the Court then posted the full list on its website. Notably, the justices denied cert in Hanson v. District of Columbia—a Second Amendment challenge to D.C.'s large-capacity magazine ban that was upheld by the D.C. Circuit. The denial in Hanson is further eveidence of an emerging split among the justices in their treatment of assault weapon bans (where at least four justices appear ready to rule soon that such weapons cannot be banned) and large-capacity magazine bans (which do not seem to have provoked quite the same level of opposition).
Also last week, Hawaii filed its response in Wolford v. Lopez—a major Second Amendent challenge to the state's post-Bruen public carry restrictions where the Ninth Circuit earlier upheld the state's default rule barring carry on prviate property without the owner's consent and a number of sensitive-place bans. Hawaii primarily argues that review would be premature given the interlocutory posture and because there is not yet any salient circuit split warranting the Court's intervention.
