On November 7 and 10, respectively, gun manufacturer Springfield Armory and the federal government filed their responses in Gustafson v. Springfield, Inc., a tort case arising out of a fatal accidental shooting in 2016.  Petitioners, parents of a 13-year-old victim, challenge the constitutionality of the Protection of Lawful Commerce in Arms Act (“PLCAA”), which provides immunity to firearms manufacturers and retailers for certain tort lawsuits. They ask the Court to determine whether Congress can require judges to dismiss lawsuits involving gun-related liability based on state common law while at the same time providing an exception to immunity for acts that that violate a state statute.

In its response, the government asks the Court to deny the petition. It argues that the PLCAA comports with the Tenth Amendment because it merely “pre-empts certain claims while imposing ‘no affirmative duty of any kind’ on ‘any branch of state government.’” The government asserts that, although the PLCAA exemptions allow lawsuits where firearms manufactures or retailers violate state statutes but not lawsuits based on common-law theories of liability, “Congress’s choice to cabin the scope of the federal preemption provision does not compel the States to exercise their authority in any particular way.” The government further argues that the PLCAA falls squarely within Congress’s powers under the Commerce Clause because “it regulates interstate commerce in part by preempting state liability that would have significant extraterritorial effects.”

Springfield Armory also asks the Court to deny the petition, pointing to the broad consensus among “[a]ll United States courts of appeal and state courts of last resort” that have considered Commerce Clause and federalism challenges to the PLCAA. The petitioners assert that the Supreme Court’s recent decision in Smith & Wesson v. Mexico did not settle the questions at issue in Gustafson, while the respondents both reference Smith & Wesson as suggesting that PLCAA’s general design is permissible and constitutional.

On October 31, a petition was filed in Schoenthal v. Raoul, challenging Illinois’s ban on carrying loaded and accessible firearms on to public transportation, including buses and trains.  The Seventh Circuit upheld the state’s restriction, concluding that firearms regulations “in crowded and confined places are ensconced in our nation’s history and  tradition” and thus “fall under the sensitive place doctrine.” In analogizing between the “how” and “why” of the ban and historical sensitive-places regulations, it notably relied on the fact that “public transit serves the ‘vulnerable population[]’ of children” and that it “is owned and operated by the government.”

Petitioners ask the Court to reverse the Seventh Circuit, arguing that there is “no historical tradition of banning law-abiding citizens from possessing firearms in crowded public locations where they may be more vulnerable.” Acknowledging that the Court recognized that in both Heller and Bruen that certain sensitive-place gun bans are permissible, petitioners assert the courts of appeals have produced “muddled” opinions in trying to answer “the question of what is a ‘sensitive place.’” They suggest that the case “would provide a useful companion to Wolford” in allowing the Court to address “the increasingly important where question in Second Amendment.”
