An Act relating to Cemeteries.

    Be it enacted by the Senate and House of Representatives in General Assembly convened, That every person, who shall willfully and maliciously destroy, mutilate, deface or injure, or remove any tomb, monument or gravestone or other structure placed within any cemetery, grave yard or place of public burial, or any fence, railing or other work for the protection or ornament of any tomb, monument, grave stone or other structure aforesaid; or of any cemetery lot within any cemetery; or shall wilfully and maliciously destroy, remove, cut, break or injure any tree, shrub or plant within any cemetery, or shall discharge any gun or other fire-arm within said cemetery, shall upon conviction thereofbe punished by a fine not exceeding one hundred dollars, or by imprisonment in a common gaol not exceeding six months, or by such fine and imprisonment both at the discretion of the Court having cognizance of the offence. Provided, that nothing contained in this act shall be construed so as to prevent the discharge of guns or other fire-arms by any military company, by order of any commissioned officer of such company while under arms and in the performance of funeral obsequies."
