“CHAP. 98.
AN ACT concerning the use of fire arms, and the use and sale of fire crackers, squibs and other artificial fireworks.
Be it enacted by the board of aldermen and board of common council of the city of Washington[,] That if any person shall fire or shoot a gun, pistol, or other fire arm, idly or for sport or amusement, within two hundred and fifty yards of any dwelling house within this city, or in any part of the city on the Sabbath, the person so firing or shooting shall forfeit and pay a fine not exceeding ten dollars, nor less than five dollars. Provided, That nothing herein contained shall be construed to affect any officer of this Corporation for firing and shooting as aforesaid in the execution of his duty, or the militia or troops of the United States, for discharging their fire arms, on days of mustering, training or rejoicing, when ordered so to shoot or fire by their commanding officer: or any person shooting as aforesaid, in the performance of any philosophical experiment or theatrical amusement, for the exhibition of which a license shall have been previously obtained: And provided, that nothing in this or any other act contained, shall be construed to prohibit any person from shooting at water fowl in the Eastern branch, or Potomac river, although such person may be within the limits herein prescribed. .
Sec. 2. And be it enacted, That if any person shall set off any fire crackers, squibs, or other artificial fireworks, in any street or avenue within one hundred yards of any dwelling house, such person shall forfeit and pay a fine not exceeding five dollars, nor less than one dollar; and if the offence be committed by a slave, it shall be punished by whipping, not exceeding thirty-nine stripes, at the discretion of the magistrate; which punishment may be commuted by the payment of the fine aforesaid; and if by an apprentice or minor, the parent or guardian shall pay the fine.
Sec. 3. And be it enacted, That it shall not be lawful for any person to sell or offer, or expose for sale, fire crackers, squibs, or other artificial fireworks, without having previously obtained a license from the Mayor for that purpose, for which license the sum of fifty dollars per annum shall be paid to the Corporation; and if any person shall violate the provisions of this section, such person shall forfeit and pay a fine not exceeding ten dollars, nor less than five dollars, for each and every offence.
