OSHKOSH, WISCONSIN, THE MUNICIPAL CODE OF THE CITY, pt. 5, ch. 10, §§ 1-15 (sine nomine 1911).

“CHAPTER X.

EXPLOSIVES—INFLAMMABLE OILS—FIRE ARMS— FIRE WORKS.

    Section 1. No person shall keep or have, or suffer to be kept or had, in any building by him or her owned or occupied within the corporate limits of this city, any greater quantity of gunpowder than fifty pounds at any one time except the same be kept twenty-five rods from any other building.
    Section 2. No person shall keep or have or suffer to be kept or had, in any building by him or her owned or occupied within the corporate limits of this city, any quantity of gunpowder unless the same is securely kept in a tin canister or a zinc magazine with a tin or zinc cap or cover.
    Section 3. No person shall keep or have or suffer to be kept or had within the corporate limits of the city, any gun cotton, dynamite, aetna, giant powder, high explosive or nitro-glycerine in any form.
    Section 4. Any person violating any of the foregoing provisions of this chapter shall be subject to a penalty of not less than five, nor more than one hundred dollars.
    Section 5. No person shall keep or have or suffer to be kept or had in any building by him or her owned or occupied within the corporate limits of said city of Oshkosh, any benzine of a quantity exceeding ten (10) gallons, or any carbon oil, naphtha or kerosene of a quantity exceeding five (5) barrels except the same be kept at least two hundred feet from the center of Main street in said city and at least ten feet from any other building.
    No person shall keep or have or suffer to be kept or had in any building by him or her owned or occupied within the corporate limits of said city, any greater quantity of benzine than ten gallons, or of carbon oil, naphtha or kerosene of a quantity exceeding five barrels except the same be stored and contained within a building the outside walls of which shall be made of brick, stone or other fire-proof material and the roof of which shall be covered on the outside with copper, tin or other fire-proof material: the windows and doors of which shall be protected and covered by iron shutters, or shall be constructed of metallic frames and wire glass.
    Section 6. It shall be unlawful for any person or persons, firm or corporation to keep or store any naphtha, benzine, gasoline, or any of the products of petroleum except kerosene and lubricating oils, or any other inflammable or explosive oils, within a space of five hundred feet of any dwelling, house, store room, building, barn, shed or any like structure within the corporate limits of the city of Oshkosh, erected before the passage and publication of this ordinance, in a quantity greater than five barrels of fifty gallons each at any one time.
    It shall be unlawful for any person, firm or corporation to store, have or keep in any tank wagon in the city of Oshkosh any gasoline, benzine, naphtha or any other explosive oils for any period of time other than during actual periods of delivery or filling or emptying the same, or while the same is in transit on the streets.
    Section 7. All oils prohibited to be kept as provided in the next preceding section, of whatever quantity, shall be kept in a receptacle, the materials for which shall be of metal, properly coated and free from leakage, and which shall not be of a greater capacity than five barrels. Any person, firm or corporation desiring to maintain any such receptacle shall, before locating same within the corporate limits of the city of Oshkosh, apply to the board of public works or any building inspector hereafter appointed for a permit, which such application shall state the dimensions of the receptacle, the location in which the same is to be placed, and any other facts necessary to show a compliance with this chapter. Upon the said board of public works or such building inspector being satisfied that the provisions herein set forth will be complied with, they shall issue the permit as requested. Such receptacle shall thereupon be buried in the ground to the satisfaction of the chief of the fire department. No such receptacle now existing shall continue to be maintained unless within ninety days after the passage and publication of this ordinance the same shall be made to conform to the requirements of this and the next preceding section.
    Section 8. It shall be unlawful for any person or persons, firm or corporation to keep or store any kerosene or lubricating oil within the corporate limits of the city of Oshkosh in any quantity greater than ten (10) barrels of fifty (50) gallons each, at any one time, unless the same shall be stored and contained within a building which shall be constructed of brick, stone or other fireproof material: the windows and doors of which shall be protected and covered by iron shutters, or shall be constructed of metallic frames and wire glass.
    Section 9. Before keeping or storing any oils as provided in sections 5 and 8 of this chapter, the person, firm or corporation desiring so to do shall make application therefor in writing to the board of public works or any building inspector hereafter appointed, which application shall describe and state the location of the building where such oils are to be kept and any other facts necessary to show a compliance with this chapter. When said board of public works or building inspector shall have inspected such location and building or the plans therefor and shall be satisfied that the requirements of this chapter will be complied with they shall issue such permit.
    Section 10. Any person, firm or corporation violating any of the provisions of the five next preceding sections of this chapter shall be subject to a fine of not less than twenty-five dollars nor more than one hundred dollars, together with costs of prosecution, for each and every offense, and in default of payment thereof to be committed to the county jail of Winnebago county until such fine and costs are paid, not to exceed thirty days nor less than ten days, or by both such fine and imprisonment.
    Section 11. In case of a firm, any member of said firm, and in case of a corporation, the president, secretary or manager thereof shall be liable to arrest and conviction for violation of any of the provisions of this chapter.
    Section 12. Any person who shall fire or discharge any gun, pistol, fowling piece or other firearm within the limits of the city of Oshkosh except in the necessary defense of his person or property, shall pay a fine of not less than one dollar nor more than ten dollars for each offense.
    Section 13. Any person who shall sell, loan or furnish to any minor any gun, pistol, fowling piece or other firearm within the city of Oshkosh, shall pay a fine of not less than five dollars nor more than twenty-five dollars for each such offense.
    Section 14. Any person who shall fire, discharge or set off within the limits of the city of Oshkosh any rocket, cracker, torpedo, squib, or other fireworks or thing containing any substance of explosive nature, shall pay a fine of not less than one dollar nor more than ten dollars for each such offense. Provided, that the mayor may by proclamation permit the use of fireworks on the Fourth day of July and on such other days as he may deem proper.
    Section 15. Any person who shall discharge or fire off any cannon or piece of artillery in any street, or avenue, alley, park or place within the limits of the city of Oshkosh, without a written permission from the mayor, shall pay a fine of not less than ten dollars nor more than thirty dollars for each such offense.”
