"A LAW for the better Securing of the City of New-York, from the Danger of Gun-Powder...
...BE it therefore Ordained by the Mayor, Aldermen and Commonalty of the City of New-York, convened in Common Council, and it is hereby Ordained by the Authority of the same, That from and after the Publication hereof, no Person or Persons whatsoever inhabiting within the said City, within two Miles of the City-Hall of the said City, shall presume to keep in any House, Shop, Cellar, Store-House, or other Plasse within the said City (his Majesty's Garrison and Magazine only excepted) any more or greater Quantity of Gun-powder at one Time, than Twenty-eight Pounds weight, (except in the magazines or Powder-House aforesaid) under the Penalty of Ten Pounds current Money of New-York, for every Offence.
II. AND be it further Ordained by the Authority aforesaid, That the Common Council of the said City, during their Pleasure, shall and will license and appoint, a good, sober, discreet, and sufficient Inhabitant of the said City, to be Store-Keeper of the said Magazine or Powder-Houses, all such Gun-Powder as shall thereunto be brought, to be safely kept and store; and for which the said Store-Keeper shall be accountable to the Owners thereof (Lightning or other unavoidable Accidents excepted) and who shall, as often as required, every Day between the Hours of Ten and Twelve in the Morning, and Two and Four in the Afternoon, give his Attendance for receiving into, and delivering out of the said Magazine or Powder-House, all such Gun-Powder as shall be brought thereunto to be stored or is there-from to be delivered; and upon his receiving into his Custody any Quantity of Gun-Powder, shall give his Receipt in Writing for the fame, expressing the Quantity of Gun-Powder, and deseribing the Marks and Numbers of the Casks.
III. AND be it further Ordained by the Authority aforesaid. That the aforesaid Store-Keeper shall and may, have, demand and receive, (for the Use of this Corporation) for the Storage of all Gun-Powder in the Magazine, or Powder-House aforesaid, for every Barrel of Gun-Powder, the Sum of Three Shillings, current Money of New-York; for every Half Barrel, Two Shillings and Three Pence, of like Money; and for every Quarter Barrel, or smaller Calk, One Shilling and Six Pence, of like Money, for any Time less than one Year; and if it shall lie any longer in the said Magazine of Powder-House, than one Year, double those Sums for each Calk of Gun-Powder; (all Gun-Powder belonging to his Majesty, or to this Province, excepted.)
IV. AND be it further Ordained by the Authority aforesaid, That the aforesaid Store-Keeper, once in every Month, shall cause all the Gun-Powder in the Magazine, or Powder-House aforesaid, to be well turned; for which Services, and for receiving and delivering the same thereout, he shall have and receive, to his own Use, over and above the Rates aforesaid, from the Owner or Owners of the said Gun-Powder, the Sum of One Shilling, for every Barrel of Gun-Powder; the Sum of Nine Pence for each Half Barrel; and the Sum of Six-Pence for each Quarter Barrel, or lesser Calk, of current Money of New-York aforesaid; and if the said Store-Keeper shall neglect to give due Attendance at the Magazine, or Powder-House aforesaid, when thereunto required, at the Times aforesaid, or neglect turning, the fame, or shall take or exact greater or larger Sums of Money, for storage, receiving, and delivering, and turning of Gun-Powder, than is herein before limited and appointed, within the Hours before-mentioned; he shall, for every such Offence, forfeit and pay the Sum of Forty Shillings, current Money of New-York.
V. AND whereas the prevent Store-Keeper, with the Content of the said Corporation, for the more safe conveying of Gun-Powder to and from the said Magazine, hath provided Leather-Bags, or Covers, in order to cover all Calks of Gun-Powder, to and from the said Magazine; Be it Ordained by the Authority aforesaid, That from and after the Publication hereof, no Cart-Man, or other Person whatsoever, do presume to carry any Gun-Powder, to or from the said Magazine, or through any Part of this City, but what shall be covered with such Leather-Bags as aforesaid, under the Penalty of Forty Shillings for every Offence. All which Fines and Penalties aforesaid, shall, and may be recovered, before the Mayor, Recorder, or any one of the Aldermen of the said City; the one Half thereof to the Informer, with Costs of Suit, and the other Half to the Church-Wardens of the said City, for the Time being, for the Use of the Poor thereof.
VI. AND be it further Ordained by the Authority aforesaid, That it shall and may be lawful for the Keeper of the said Magazine, to have, take and receive, from all Persons that shall use any of the aforesaid Leather-Bags or Covers, One Penny for each Bag or Cover so by them used."
